- TERMS
1.1 TERMS OF SERVICE
These Terms of Service for Australian Users (“Terms”) are subject to the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
“Hosts”, “we,” “us,” or “our” refers to the Tanawha Forest Escape entity with whom you are contracting. “Guests”, “you”, or “your" refers to the entity who contracted Tanawha Forest Escape.
Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests". Hosts offer accommodations (a “Listing”).
1.2 TERMS OF STAY
- Check-in Date & Time: As per booking details {check_in_date}, from {check_in_time}
- Check-out Date & Time: As per booking details {check_out_date}, by {check_out_time}
- Maximum Occupancy: 7
- CONDITIONS
2.1 PARKING
- Access is via a shared driveway suitable for standard vehicles only.
- Two designated parking spaces, marked by traffic cones, are available in front of the large shed.
- Do not park near the entrance gate—this area is reserved for the downstairs unit.
- Do not block the driveway at any time.
2.2 THE LOFT NET
- The loft net is not a trampoline – no jumping is allowed.
- Please use the net with care to ensure safety at all times.
- The maximum weight capacity is 400kg.
- To maintain cleanliness for all, we kindly request that bare feet be clean or socks be worn when using this area.
- The loft net is securely fastened with multiple rope loops. For safety reasons, do no tamper with it, specially for children whose small fingers could get caught.
- Children are to be supervised at all time during the use of the lot net.
2.3 CHECK-IN & CHECK-OUT
- Check-in: From 2:00 PM
- Check-out: By 10:00 AM
- These times are strictly observed unless otherwise agreed. Please contact us to request early check-in or late check-out (subject to availability).
2.4 SEPTIC SYSTEM
- The property is on a septic system.
- Only provided septic-safe products may be used in toilets, washing machines, and dishwashers.
- Do not flush foreign objects such as wipes or feminine hygiene products.
2.5 ACCESS LIMITATIONS
- Guests are not permitted to enter the downstairs unit or its courtyard.
- Access to the forest can be done by going to the very top of the driveway and then following the public path to your right.
2.6 PETS
- Pets are not allowed on the premises.
2.7 SMOKING & VAPING
- Smoking, vaping, and use of e-cigarettes are strictly prohibited anywhere on the property.
2.8 PARTIES, EVENTS & VISITORS
- The property accommodates a maximum of 7 overnight guests.
- No parties or events are permitted.
- Visitors are not allowed on the premises at any time without prior written approval from the host.
- Breach of this rule will result in non-refundable immediate termination of your stay and additional charges may apply.
2.9 NOISE
- We kindly ask that noise be kept to a minimum after 9:00 PM on weekdays, and after 10:00 PM on weekends, out of respect for our neighbours and to maintain the peaceful, family-friendly environment.
2.10 GARBAGE & RECYCLING
- Bins are located beside the shed near the stairs.
- Yellow lid: Recycling (clean plastics, paper, etc.)
- Red lid: General waste
- Small dark green bin: Containers eligible for 10¢ refund (e.g., cans, bottles marked accordingly)
2.11 SHOES INDOORS
- Please remove shoes before entering the upstairs carpeted area.
2.12 FOOD STORAGE
- No food/drink is to be stored or consumed in the bedrooms and/or the loft net.
2.13 BBQ USAGE
- A gas BBQ is available for guest use.
- Please clean after each use. A cleaning fee may apply if left dirty.
2.14 CLEANING
- The space will be clean upon your arrival, and we kindly ask that you leave it neat, free of rubbish, and with no dirty dishes upon departure.
- If additional cleaning is required, an extra fee will apply.
2.15 MALFUNCTIONS
- Please report any issues or malfunctions as soon as possible so we can address them promptly.
2.16 CONSUMABLES
- Few consumables are provided for guests to use during their stay (e.g., cooking oil, condiments, soaps, detergents, etc.).
- These items are for on-site use only and must not be removed from the property.
2.17 DAMAGE & LOSS
- The guest is financially responsible for any damage and/or loss caused to the property, furniture, or amenities during their stay.
2.18 LOST PROPERTY
- Lost & Left-Behind Items: We are not responsible for items left behind. If found, we will hold them for 14 days and can return them at the guest’s expense upon request.
2.19 CHECK-OUT REQUIREMENTS
Before departure, guests must:
- Remove all personal belongings
- Dispose of all rubbish appropriately
- Wash and put away any used dishes
- Lock all doors and windows
- Return all keys/remotes
- Turn off all electrical and gas appliances
- Leave the property in a clean and tidy condition.
2.20 BOOKING REQUIREMENT
- Minimum age to book: Guests myst be at least 18 years old to book and stay at the property. Bookings made by individuals under this age without approval will be cancelled.
- Guest Identity Verification: All guests making a direct booking must provide a copy of valid government-issued photo identification within 24 hours of booking to confirm the reservation. Failure to do so may result in cancellation.
2.21 CANCELLATION POLICY
- For third-party booking platforms (eg. Airbnb, Vrbo, etc.), their cancellation policy applies.
- For direct bookings, our standard cancellation terms apply:
- Full refund: 100% refund if canceled at least 14 days before check-in.
- Partial refund: 50% refund if canceled between 7 and 14 days before check-in.
- No refund: After 7 days before the check-in date, no refund is given.
- Force Majeure: We shall not be held liable for cancellations or changes due to events beyond our control, including but not limited to natural disasters, pandemics, or government-imposed travel restrictions. In such cases, refunds may be offered at our discretion.
2.22 PAYMENT TERMS
- For Direct Bookings:
The fullamount is required at the time of booking to secure your reservation. Payment over the phone is not available. Instead, you will received an email with your booking details and a secured payment link. Payment must be completed within 24 hours o confirm your stay. - For Bookings via Third-Party Platforms (e.g., Airbnb, Booking.com):
Payment terms and processing are managed by the booking platform. Guests must adhere to the payment schedule and conditions outlined at the time of booking.
2.23 LIABILITY WAIVER
By booking this property, the guest acknowledges and agrees to the following:
- The property includes areas such as a loft net, stairs, and balcony, which may pose safety risks, especially to children.
- The Guest assumes full responsibility for their own safety and the safety of all individuals in their party.
- The Host shall not be held liable for any accidents, injuries, or damages occurring on the premises.
- The Guest agrees to use all areas of the property responsibly and ensure children are supervised at all times.
- The Guest acknowledges the internal loft net’s weight limit of 400kg maximum and agrees that children will not jump on it.
- The Guest understands that failure to adhere to safety guidelines may result in immediate termination of their stay without a refund.
- Guests are responsible for supervising children and infants at all times. All responsibility and duty of care for them must be provided by you, including their personal equipment and needs. The Host accepts no responsibility for any incidents or injuries resulting from these features.
2.24 DISPUTES & GOVERNING LAW
- This agreement is governed by the laws of Queensland, Australia.
- Any legal disputes will be resolved in Queensland courts.
- Platform-specific dispute processes (e.g. Airbnb, Booking.com) may also apply if booked through those channels.
- ACKNOWLEDGEMENT
By booking and/or staying at Tanawha Forest Escape—whether via a third-party platform, or directly—you confirm that:
- You have read and agree to these Terms and Conditions
- You accept full responsibility for your group’s compliance
- You understand that breach of these rules may result in cancellation of your stay without refund.
